Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of all educational products and services offered by the Nutritional Pathology Institute, Dr. Brandon Lundell, D.C., and Harmony Healing Center (collectively, "NPI," "we," "us," or "our"), including our website, online learning platform, webinars, courses, seminars, mentorship programs, certification programs, and digital downloads.
By accessing our website, creating an account, registering for any program, or completing a purchase, you agree to be bound by these Terms. If you do not agree, do not access or use our services.
These Terms should be read alongside our Privacy Policy and General Disclaimer, both of which are incorporated by reference.
1. Eligibility
NPI programs are designed for licensed or credentialed healthcare professionals. By enrolling in any NPI program, you represent and warrant that:
You are at least 18 years of age
You hold a valid professional license or credential in your jurisdiction, or are enrolled in an accredited professional training program
You will apply any educational content only within the scope of your license and applicable law
The information you provide during registration is accurate and complete
NPI reserves the right to verify professional credentials and to deny access to any individual who does not meet these eligibility requirements.
2. NPI Programs and Services
NPI offers the following types of educational products and services, each subject to the specific terms described in this section and in Section 4 (Refunds and Cancellations):
2.1 Free Webinars
NPI periodically offers free, live webinars in partnership with sponsors including Biotics Research Corporation. Registration is required. By registering, you agree to receive communications related to the webinar and, where indicated at registration, promotional communications from NPI and its sponsors. You may opt out of marketing communications at any time.
2.2 Paid Webinars and Recorded Events
Certain webinars and recorded presentations are available for purchase. Access to purchased recordings is granted for the period specified at the time of purchase. NPI reserves the right to retire or update recorded content.
2.3 Practice Accelerator Seminar
The Practice Accelerator is a full-day virtual educational seminar held on a scheduled date. Registration grants access to the live event and, where indicated at the time of purchase, a recording of the event. Specific refund terms for this event are set out in Section 4.2.
2.4 Mentorship Program
The NPI Mentorship Program is a cohort-based professional development program with limited enrollment in each cohort. Enrollment grants access to scheduled group sessions, course materials, and any resources specified in the program description at the time of enrollment. Mentorship enrollment terms and refund policy are set out in Section 4.3.
2.5 Certification Course
The NPI Certification Course is a structured year-long program. Completion of the Certification Course, including all required assessments, leads to a Certificate of Completion issued by NPI. This certificate represents completion of NPI's internal educational program only. It does not confer a professional license, expand scope of practice, or constitute certification by any external licensing or credentialing body. Certification course enrollment and refund terms are set out in Section 4.4.
2.6 Digital Downloads and Lead Magnets
NPI offers downloadable resources including protocol guides, reference documents, and educational materials. Some resources are available at no cost in exchange for email registration. Paid digital downloads are subject to the refund terms in Section 4.5.
3. Account Registration and Access
Certain NPI programs require you to create an account on our LearnWorlds-powered learning platform. You are responsible for:
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying NPI immediately if you suspect unauthorized use of your account
Accounts are for individual use only. You may not share your login credentials, transfer your enrollment, or allow any other person to access your account or course materials. Violation of this policy may result in immediate account termination without refund.
NPI uses LearnWorlds as its learning management system and website platform. Your use of the platform is also subject to LearnWorlds' Terms of Service and Privacy Policy.
4. Refunds and Cancellations
NPI's refund policy varies by product type. Please review the applicable terms before purchasing.
4.1 Free Webinars
No payment is required for free webinars. Registration may be cancelled at any time. NPI is not responsible for technical issues preventing attendance, but will make a recording available where possible.
4.2 Practice Accelerator and Live Events
Refund Policy: Practice Accelerator and Live Seminars
Cancellation 14 or more days before the event date: Full refund.
Cancellation 7 to 13 days before the event date: 50% refund or full credit toward a future NPI event.
Cancellation fewer than 7 days before the event date: No refund. Event credit may be issued at NPI's discretion.
No-shows: No refund. Recording access (where included) remains available.
If NPI cancels or reschedules an event, registered participants will receive a full refund or the option to transfer their registration to the rescheduled date.
4.3 Mentorship Program
Refund Policy: Mentorship Program
The program fee is non-refundable. If you are unable to attend your enrolled cohort, your payment may be transferred to a future program date. If you withdraw after the program begins, you are eligible to attend the next available cohort, less the prorated amount based on the number of monthly cycles completed (calculated as total fee divided by six, multiplied by months elapsed). All funds must be used within one (1) year of the initial enrollment date.4.4 Certification Course
Refund Policy: Certification Course
Cancellation before the course start date: Full refund, less a $150 administrative fee.
Cancellation within 14 days of the course start date: 50% refund.
Cancellation after accessing any course content or after 14 days from the start date: No refund.
Payment plans: Enrollment via payment plan is a binding commitment to the full course fee. Early cancellation does not eliminate remaining payment obligations unless a refund is expressly granted.
4.5 Digital Downloads
All sales of digital downloads are final once the file has been accessed or downloaded. If you experience a technical issue preventing download, contact us within 7 days of purchase and we will resolve it.
4.6 General Refund Process
To request a refund, email assistant@drbrandonlundell.com with your name, purchase date, program name, and reason for the request. Refund requests will be reviewed and processed within 10 business days. Approved refunds will be returned to the original payment method.
NPI reserves the right to deny refund requests that do not meet the criteria above or that show evidence of abuse of this policy.
5. Billing and Auto-Renewal
All purchases are processed in U.S. dollars through Stripe. By completing a purchase, you authorize NPI to charge the payment method you provide for the amount displayed at checkout.
Where NPI offers subscription or recurring payment options, you will be notified of the renewal amount and renewal date at least 25 days in advance of any automatic charge, in accordance with Colorado law (C.R.S. § 6-1-733). You may cancel a subscription or recurring payment plan by contacting us at least 5 business days before the next scheduled charge.
If a payment fails, NPI will attempt to contact you using the email address on file. Access to programs may be suspended until payment is resolved. NPI is not responsible for content missed during a payment suspension period.
6. Continuing Education Credits
Where NPI programs indicate that continuing education (CE) credits may be available, the following terms apply:
CE credit availability and state-by-state acceptance varies. NPI does not represent that any program satisfies CE requirements for any particular state, license type, or renewal period.
Some states require pre-approval of CE providers before credits can be applied. It is your sole responsibility to verify that any NPI program is accepted by your licensing board before relying on it for CE purposes.
CE certificates issued by NPI reflect completion of the program only. NPI does not submit CE records to any licensing board on your behalf.
CE approval status may change. Approval current at the time of enrollment does not guarantee acceptance at the time of license renewal.
NPI recommends verifying CE acceptance with your state licensing board before enrolling in any program for CE purposes. No refunds will be issued if a program is not accepted for CE credit in your jurisdiction.
7. Intellectual Property and Content Use
All NPI educational content — including but not limited to course videos, webinar recordings, written materials, protocols, case studies, slide decks, email content, and downloadable resources — is the proprietary intellectual property of Dr. Brandon Lundell, D.C. and the Nutritional Pathology Institute, protected by U.S. copyright law.
7.1 License Granted to You
Upon enrollment and payment, NPI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the purchased content for your own personal professional development. This license does not grant you the right to:
Download, reproduce, or store content beyond the access provided by the platform
Share, redistribute, or resell any NPI content to any third party
Use NPI content for commercial purposes, including teaching or training others
Record any live webinar, seminar, or session without NPI's express written permission
Remove or alter any copyright, trademark, or proprietary notices
7.2 Platform Protections
NPI's learning platform includes technical protections against unauthorized recording and redistribution. Circumventing these protections is prohibited and may constitute a violation of the Digital Millennium Copyright Act (DMCA) in addition to breach of these Terms.
7.3 Your Content
If you submit content to NPI platforms — such as questions, comments, case submissions, or discussion posts — you grant NPI a non-exclusive, royalty-free license to use that content within the platform for educational purposes. You represent that any content you submit does not violate the rights of any third party and complies with applicable patient privacy laws, including HIPAA.
8. Acceptable Use
By accessing NPI's platform and programs, you agree not to:
Share your account credentials with any other person
Enroll on behalf of another person without their knowledge and consent
Submit false or misleading information during registration or in platform communications
Use NPI content or platforms for any unlawful purpose
Harass, threaten, or engage in abusive conduct toward NPI staff, instructors, or other participants
Introduce malware, viruses, or other harmful code to the platform
Attempt to gain unauthorized access to any part of the platform or to other users' accounts
NPI reserves the right to terminate access for any user who violates these acceptable use standards, without refund. We also reserve the right to request full compensation for anyone who uses your credential to access course materials with or without your permission.
9. Sponsor Disclosure
Certain NPI programs and events are sponsored by third parties, including Biotics Research Corporation. Sponsored programs will be identified as such at the time of registration.
10. Disclaimer of Warranties
NPI's programs and platform are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, NPI disclaims all warranties, express or implied, including but not limited to:
Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the platform will be uninterrupted, error-free, or free from viruses
Warranties regarding the accuracy, completeness, or currency of any educational content
Warranties that CE credits will be accepted in any jurisdiction
Warranties that application of educational content will produce specific clinical outcomes
NPI makes no representation that educational content constitutes the standard of care in any jurisdiction or for any patient population.
11. Limitation of Liability
To the fullest extent permitted by applicable law, NPI, Dr. Brandon Lundell, D.C., Harmony Healing Center, and their respective affiliates, employees, agents, and instructors shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, goodwill, or other intangible losses
Clinical outcomes resulting from application of educational content
Technical failures, platform outages, or loss of access to course materials
Unauthorized access to or alteration of your data
In any event, NPI's total aggregate liability to you for any claim arising from or related to your use of NPI services shall not exceed the total amount you paid to NPI in the 12 months preceding the claim.
Some jurisdictions do not permit exclusion or limitation of certain damages. If you are in such a jurisdiction, the above limitations apply to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless NPI, Dr. Brandon Lundell, D.C., Harmony Healing Center, and their affiliates, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or related to:
Your use of or access to NPI programs or platforms
Your violation of these Terms
Your application of NPI educational content in your clinical practice
Any content you submit to NPI platforms
Your violation of any applicable law or the rights of any third party
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. You agree that any dispute arising from these Terms or your use of NPI services shall be subject to the exclusive jurisdiction of the courts located in Colorado, except as provided in Section 13.2.
13.2 Binding Arbitration
Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of NPI services shall be resolved by binding arbitration under the American Arbitration Association (AAA) Commercial Arbitration Rules, with a single arbitrator, conducted in Colorado.
Arbitration is less formal than a court proceeding, does not involve a jury, and is subject to very limited review by courts. The arbitrator may award the same relief as a court. The arbitrator's decision shall be final and binding, and may be entered as a judgment in any court of competent jurisdiction.
You and NPI each waive the right to a trial by jury and the right to participate in a class action or class-wide arbitration. All claims must be brought in your individual capacity.
13.3 International Users
If you are located outside the United States, mandatory consumer protection laws in your jurisdiction may apply regardless of the choice of law and dispute resolution clauses above. Nothing in these Terms is intended to waive protections that cannot be waived under applicable mandatory law.
14. Term and Termination
These Terms remain in effect for as long as you access or use NPI services. NPI may terminate or suspend your access at any time, with or without notice, for:
Violation of these Terms
Conduct that NPI determines, in its sole discretion, is harmful to other users, NPI, or third parties
Non-payment of fees
Providing false registration information
Upon termination, your license to access NPI content is revoked. Provisions of these Terms that by their nature should survive termination — including intellectual property, indemnification, limitation of liability, and dispute resolution — shall survive.
You may terminate your account at any time by contacting NPI. Termination does not entitle you to a refund except as expressly provided in Section 4.
15. Modifications to These Terms
NPI reserves the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or through a notice on the platform. Your continued use of NPI services after changes are posted constitutes acceptance of the revised Terms.
For programs you have already enrolled in, the Terms in effect at the time of your enrollment govern that enrollment, except where applicable law requires otherwise.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and General Disclaimer, constitute the entire agreement between you and NPI regarding your use of our services, and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.
Waiver: NPI's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without NPI's prior written consent. NPI may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure: NPI is not liable for failure to perform its obligations due to causes beyond its reasonable control, including natural disasters, internet outages, platform provider failures, or government restrictions.
No Agency: Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency between you and NPI.
